Introduction

Taco John’s International, Inc. respects your privacy and is committed to protecting it by complying with this Privacy Policy. This Privacy Policy describes the types of information Taco John’s International, Inc. (“TJI,” “we,” or “us”) may collect from you or that you may provide through use of www.tacojohns.com, our applications, and other online services that link to this Privacy Policy (collectively our “Sites”). It describes our practices for collecting, using, maintaining, protecting, and disclosing that information.

This Privacy Policy applies to information we collect:

  • Via our Sites;
  • In email, text, multimedia, and other electronic messages between you and our Sites;
  • When you interact with our profiles on third-party social media sites; and
  • When you interact with our profiles, advertising, or applications on third-party websites and services, if those applications or advertising include links to this Privacy Policy.

It does not apply to information collected by:

  • Us offline or through any other means, including on any other website operated by TJI or any third party (including our affiliates);
  • Our franchisees; or
  • Any third party (including our affiliates), including through any application or content (including advertising) that may link to or be accessible from our Sites.

Please read this Privacy Policy carefully to understand our policies and practices regarding your information and how we will treat it. By interacting with our Sites or providing us with your information, you agree to the collection, use, and sharing of your information as described in this Privacy Policy. If you do not agree with our policies and practices, you must choose not to use our Sites. This policy may change from time to time (see Changes to our Privacy Policy). Your continued use of our Sites after we make changes is deemed acceptance of those changes, so please check the policy periodically for updates.

Children Under the Age of 13

We do not knowingly or intentionally collect personal information from children under 13. If you are under 13, do not use or provide any information on our Sites, register as a user, make any purchases through our Sites, use any of the interactive or public comment features of our Sites, or provide any information about yourself to us, including your name, address, telephone number, email address, or any screen name or username you may use. If we learn that we have collected or received personal information from a child under 13 without verification of parental consent, we will delete that information as quickly as possible. Information We Collect About You

“Personal data” is information that identifies, relates to, or describes, directly or indirectly, you as an individual, such as your name, email address, telephone number, home address, or payment information. The types and categories of personal data we collect or process include:

  • Account and contact information, including name, address (such as any address you provide for order delivery), email address, phone number, social media usernames, and other contact information you provide us.
  • Payment information, including credit card or debit card information and information about the payment methods you use in connection with your purchases on the Sites.
  • Account history, including information about your account, transactions, purchases, tips, order history, or discounts.
  • Demographic information, including your age, gender, income level, education, or family or marital status, if you have consented to such information collection as part of a survey.
  • Location information, including general geographic location such as country, state, or city, and precise geolocation, if you have enabled and consented to location information collection.
  • Device information, including your IP address, device identifiers, operating system and version, preferred language, hardware identifiers, browser type and settings, and other device information.
  • Content and information you elect to provide in any reviews you make through the Sites or provide in any emails, chats, or other communications sent to us.
  • Loyalty program membership and opt-in to other marketing programs, including SMS marketing opt-in.
  • Information you provide for your loyalty program profile, including your favorite Taco John’s location, photo, and date of birth.
  • Employment information that you elect to provide us when applying for a job with a Taco John’s location.

Some of the information identified above, including location information, may be considered sensitive data under certain laws. If required under applicable law, we will collect and process sensitive personal data only with your consent. If you choose not to provide or allow us to collect some information, we may not be able to provide you with requested features, services, or information.

We also collect:

  • Statistical or aggregated information. Statistical or aggregated data does not directly identify a specific person, but we may derive non-personal statistical or aggregated data from personal data. For example, we may aggregate personal data to calculate the percentage of users accessing a specific feature of the Sites.
  • Technical information. Technical information includes information about your internet connection and usage details about your interactions with the Sites, such as clickstream information to, through, and from our Sites (including date and time), products that you view or search for, page response times, download errors, length of your visits to certain pages, link you click on, page interaction information (such as scrolling, clicks, and mouse-overs), or methods used to browse away from a page.

If we combine or connect non-personal statistical or technical data with personal data so that it directly or indirectly identifies an individual, we treat the combined information as personal information.

How We Collect Your Personal and Other Data

You Provide Information to Us

We collect information about you when you interact with our Sites, such as when you:

  • Create or update an account;
  • Place an order;
  • Participate in surveys, sweepstakes, contests, or promotions;
  • Fill out any forms on our Sites;
  • Someone refers you to us;
  • Contact us via email, the contact us form, or send us any other communication;
  • Sign-up for our mailing list, SMS messages, or other marketing;
  • Participate in our loyalty program;
  • Purchase or redeem a gift card;
  • Run a search on the Sites;
  • Report a problem with the Sites; or
  • Submit a job application.

Automatically Through Our Services

As you navigate and interact with our Sites, we may use automatic data collection technologies to collect information, including personal data. Information collected automatically may include usage details, IP addresses, operating system, and browser type, as well as information collected through cookies, web beacons, pixels, and other tracking technologies. including details of your interactions with our Sites, such as traffic data, location data, logs, and other communication data, order amount and items, and which resources and Site features you access and use.

We may use these automatic collection technologies to collect information about your online activities over time and across third-party sites or other online services (behavioral tracking). Using automatic collection technologies helps us improve our Sites and deliver a better, more personalized experience.

The technologies we use for this automatic data collection may include:

  • Cookies. A cookie is a small file placed on your device when you interact with the Sites. You may refuse to accept or disable cookies by activating the appropriate setting on your browser or device. However, if you select this setting, you may be unable to access certain features of the Sites.
  • Pixels. Some parts of the Sites and our emails may contain small electronic files known as pixels (also referred to as web beacons, tracking pixels, clear gifs, pixel tags, and single-pixel gifs) that permit TJI, for example, to count users who have visited those parts of the Sites or opened an email and for other related statistics (for example, recording the popularity of certain content and verifying system and server integrity). Some pixels are provided by our third-party service providers and allow such providers to access some of the information we collect about you. These third-party partners include, but are not limited to, Meta, TikTok, Google, Snap, AdTaxi, StackAdapt, TheTradeDesk, and Attentive, whose privacy policies may differ from our own, and where you may make your privacy choice preferences through methods available on their websites. By visiting our Sites, you agree that your information may be shared with these third parties to perform marketing and other services. You may opt-out of the collection of your data by some of these third-party service providers by visiting their websites and changing your account settings. Please note that some features may be unavailable as a result of changing those settings.

From Business Partners and Service Providers

We may receive personal data about you from other sources and combine that with information we collect directly from you. For example, we may obtain information about you from service providers we engage to perform services on our behalf, such as email platform providers, payment processors, marketing and promotion services, gift card program providers, and analytics, security and anti-fraud services. Our app allows you to sign in to your account via Apple and Facebook, and if you use this feature, we may obtain information about you from the provider you choose to use.

Third-Party Use of Cookies and Other Tracking or Location Technologies

Some content or applications, including advertisements, on the Sites are served by third parties, including advertisers, ad networks and servers, content providers, and application providers. These third parties may use cookies alone or in conjunction with web beacons or other tracking or location technologies to collect information about you when you use our Sites. If you sign up for SMS messages, third-party providers may use cookies to personalize your experience. The information they collect may be associated with your personal information, or they may collect information, including personal information, about your online activities over time and across different websites and other online services. They may use this information to provide you with interest-based (behavioral) advertising or other targeted content.

We do not control these third parties’ tracking technologies or how they may be used. If you have any questions about an advertisement or other targeted content, you should contact the responsible provider directly.

How We Use Your Information

We use information that we collect about you or that you provide to us, including any personal data:

  • To provide you with the Sites and any content, features, information, products, or services that we make available through the Sites.
  • To provide you with information, products, or services that you request from us, or to respond to requests or comments from you.
  • To fulfill your orders.
  • To activate or update your Loyalty program account and provide you with notices about your account, rewards, and offers.
  • To allow you to participate in interactive features on our Sites, including sweepstakes, contests, surveys, employment applications, comment forms, or any other online or mobile interactive activities.
  • To fulfill any other purpose for which you provide it.
  • To detect and prevent fraud.
  • To carry out our obligations and enforce our rights arising from any contracts entered into between you and us, including for billing and collection.
  • To notify you about changes to our Sites or any products or services we offer or provide through it.
  • To inform our advertising and marketing.
  • To track your consent choices.
  • To optimize our menu items.
  • To promote our Sites, services, business, and offerings by publishing advertising on our own products and by placing ads on third parties’ services. We may use your information to model, segment, target, offer, market, and advertise our Sites, products, and services.
  • In any other way we may describe when you provide the information.
  • For any other purpose with your consent.

The usage information we collect, whether connected to your personal data or not, helps us improve our Sites and deliver a better and more personalized experience by enabling us to:

  • Estimate our audience sizes and usage patterns.
  • Store information about your preferences to customize the Sites to your individual needs and interests.
  • Speed up your searches.
  • Recognize you when you return to our Sites.
  • To improve our marketing, products, and services.

We may use your location information to find your nearest Taco John’s restaurants, provide personalized content or advertising, to enhance your dining experience, to improve your order speed, to allow you to view coupons, deals, or promotions based on your location, to assist us with analytics, to provide you with personalized offers, and to improve our marketing and customer service.

Disclosure of Your Information

We may disclose aggregated information about our users and information that does not identify any individual, without restriction.

We may disclose personal information that we collect or that you provide as described in this Privacy Policy:

  • To our affiliates.
  • To our franchisees who independently own and operate Taco John’s restaurant locations.
  • To contractors, service providers, and other third parties we use to support our business, including, but not limited to, consultants, rewards platform providers, payment processors, marketing and advertising vendors, and data analytics providers.
  • To a buyer or other successor in the event of a merger, sale, or transfer in which personal information held by TJI about users of our Sites is among the assets transferred.
  • To fulfill delivery orders.
  • To fulfill the purpose for which you provide it.
  • For any other purpose disclosed by us when you provide the information.
  • With your consent.
  • To comply with any court order, law, or legal process, including to respond to any government or regulatory request.
  • To enforce or apply our Terms of Use and other agreements, including for billing and collection purposes.
  • If we believe disclosure is necessary or appropriate to protect the rights, property, or safety of TJI, our customers, our franchisees, or others.

Protection of Information

We have in place various safeguards to preserve the security and integrity of information you provide to us and that we share with third-party service providers. These include physical, technical, and administrative security measures to protect your information against accidental or unlawful destruction, loss, or alteration, and against unauthorized disclosure or access. While we take efforts to protect against such incidents, we cannot guarantee or warrant the security of our systems at all times, and do not accept liability for accidental or unintentional disclosure of your information. In the event that any information is compromised as a result of a data security breach, we will take reasonable steps to investigate the matter and, as appropriate, notify individuals whose information may have been compromised. We will take additional steps as required by applicable laws and regulations.

The safety and security of your information also depends on you. You are responsible for taking steps to protect your personal data against unauthorized use, disclosure, and access.

Choices About How We Use and Disclose Your Information

We strive to provide you with choices regarding the personal information you share with us. This section describes mechanisms you can use to control certain uses and disclosures of your information.

Advertising, marketing, cookies, and other tracking technologies choices:

  • Cookies. You can set your browser or device settings to refuse all or some cookies, or to alert you when cookies are being sent. If you disable or refuse cookies, please note that some parts of our Sites may then be inaccessible or not function properly.
  • Do Not Track. Some browsers include a “Do Not Track” (DNT) setting that can send a signal to the online services you visit, indicating you do not wish to be tracked. Because there is no common understanding of how to interpret the DNT signal, our Sites may not respond to all DNT signals from browsers. Instead, you can use the range of other tools to control data collection and use, including the cookie controls and advertising controls described in this policy.
  • Promotional Offers from TJI. If you do not wish to have your contact information used by TJI to promote our own products or services through our Sites, you can opt-out by unsubscribing or by adjusting your user preferences in your account profile by checking or unchecking the relevant boxes. If we have sent you a promotional email, you may use the unsubscribe link at the bottom of the email or send an email to [email protected] asking to be omitted from future email distributions.
  • Text Messaging. Consent to receive automated marketing text messages is not a condition of any purchase. You can opt-out of receiving further commercial text messages via our messaging service by responding to any of our text messages with the following replies: STOP, END, CANCEL, UNSUBSCRIBE, or QUIT.   • Disclosure of Your Information for Third-Party Advertising. We do not control third parties’ collection or use of your information to serve interest-based advertising. However, these third parties may provide you with ways to choose not to have your information collected or used in this way. Location data choices:

  • Location Data. You can choose whether to allow the Sites to collect and use real-time location information from your device through your device’s privacy settings or your browser settings. If you block the use of location information, some of the Sites’ features may become inaccessible or not function properly.

Your State Privacy Rights

Depending on your state of residency, you may have certain rights related to your personal data, including:

  • Access and Data Portability. You may confirm whether we process your personal data and access a copy of the personal data we process. To the extent feasible and required by state law, depending on your state, data will be provided in a portable format. Depending on your state, you may have the right to receive additional information, and it will be included in the response to your access request.
  • Correction. You may request that we correct inaccuracies in your personal data that we maintain, taking into account the information’s nature and processing purpose.
  • Deletion. You may request that we delete personal data about you that we maintain, subject to certain exceptions under applicable law.

Important: The exact scope of these rights varies by state. There are also several exceptions in which we may not be obligated to fulfill your request.

Colorado Loyalty Program Disclosure

The following categories of personal data may be processed for targeting advertising:

  • Identifiers. Such as your IP address, phone number, and email address.
  • Commercial information. Purchasing history and other similar info.
  • Internet and other electronic network activity information. Data like browsing or search history.

We don’t sell or process sensitive data for targeted advertising. We only disclose personal information and sensitive data collected in connection with the loyalty program to our third-party providers and processors. We may share personal data with data brokers to improve our marketing efforts.

We do not have any “Loyalty Program Partners” as defined by Colorado’s privacy law.

If you choose to delete your loyalty program account, we will no longer be able to track rewards points or which rewards or offers apply to you, so you will no longer be eligible for them.

We currently don’t collect any sensitive personal data for the loyalty program as defined by Colorado’s privacy law.

Retention of Information

We keep the categories of personal data described in this policy for as long as reasonably necessary to fulfill the purposes described, or for as otherwise legally permitted or required, such as maintaining the Sites, operating our organization, complying with our legal obligations, resolving disputes, and for safety, security, and fraud prevention. This means that we consider our legal and business obligations, potential risks of harm, and nature of the information when deciding how long to retain personal data. At the end of the retention period, personal data will be deleted, destroyed, or deidentified.

Accessing, Correcting, or Deleting Your Information

You can review and update your personal information by logging in to your account on the Sites and visiting your account profile page. You may also send us an email at [email protected] to request access to, correct, or delete any personal information that you have provided to us.

We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect.

Changes to Our Privacy Policy,

We may update this policy from time to time, and we will provide notice of any such changes  as required by law. The date the privacy policy was last updated is identified at the top of the page. We will notify you of changes to this policy by updating the “last updated” date and posting the updated policy on the Sites. We may email or otherwise communicate reminders about this policy, but you should check our Sites periodically to see the current policy and any changes we have made to it.
